LEGAL AND REGULATORY FRAMEWORK FOR THE BARNAHUS MODEL IN UKRAINE

The article analyzes the process of implementing the Barnahus model in Ukraine as a tool for effective protection of the rights of children who have suffered from or witnessed violence. In the context of the increasing number of cases of domestic and sexual violence against children recorded in official statistics, it is of particular importance to create institutional and legislative mechanisms that comply with the principles of «friendly justice» and ensure a comprehensive approach to providing assistance to children. The focus of the study is to analyze the legal framework that forms the basis for the functioning of specialized centers based on the Barnahus model, as well as its compliance with international standards, in particular the provisions of the UN Convention on the Rights of the Child, the Istanbul Convention and European standards for the functioning of such centers. It is examined the main stages of implementation of the Barnahus model in Ukraine: from the approval of the National Strategy for Reforming the Justice System for Children to the adoption of a law in 2024 that establishes the legal basis for the functioning of such centers. The article identifies the key legislative innovations that ensure the institutionalization of the model, including: the prohibition of alternative dispute resolution in cases of domestic violence, the establishment of Barnahus centers as specialized support services, the definition of age-appropriate procedures for interrogating a child, etc. Based on a systematic analysis of current legislation and by-laws, the author outlines the legal gaps that impede the full functioning of the model and points out the need for further improvement of interagency coordination mechanisms, professional training, and the expansion of the geographical coverage of the centers. It is emphasized that the legislative initiative to introduce the Barnahus model is not only a response to internal social challenges, but also evidence of Ukraine’s fulfillment of its international obligations in the field of child protection.
